Registration Intermediaries

As of 1 April 2015, the KNVB has new regulations in place for sports agents. These ‘Regulations for Intermediaries’ seek to regulate intermediaries in the interest of Dutch football and to separate the wheat from the chaff. Only persons registered as intermediaries with the KNVB may act as such.

Introduction of the regulations is the direct result of FIFA's decision to discontinue the club licensing system for sports agents. On 11 June 2014, the FIFA congress agreed to an amendment of the FIFA Articles of Association, as a result of which sports agents and representatives no longer have to take an examination to be allowed to act as intermediaries. They must, however, be registered with the KNVB if they are involved in a transaction. From now on, FIFA will apply a "minimum rule" for intermediaries, but it does offer all national football associations the possibility of extending this.

The Regulations for Intermediaries can be considered the KNVB's response to this. Together with Pro Agent, ProProf, VVCS, FBO, ECV and the clubs, the sports agents working party has developed a system under which intermediaries are bound by the rules.

Registration of intermediaries

A natural person who or legal entity that, for a fee or otherwise, wants to represent players and/or clubs in negotiations on the formation of players' contracts and/or agreements on the transfer of players can be registered as intermediary with the KNVB at any time. Intermediaries may register as natural person and/or legal entity. If an intermediary is a legal entity, every employee of that legal entity who is directly involved in negotiations on the formation of players' contracts and/or agreements on the transfer of players must register as intermediary in addition to that legal entity itself. Registrations are valid for up to one year; they expire on 31 March of the year following registration. This means that registrations must be renewed every year.

Registration as natural person

For registration as a natural person, the following documents must be uploaded to the Portal for intermediaries:

  1. A completed and signed natural person intermediary statement;
  2. A copy (front and back) of a valid passport and/or valid ID;
  3. An original Certificate of Conduct. The statement must have been issued: (a) no more than six months before the registration; and (b) for the purpose of representing players and/or clubs. If the natural person is not registered in the Dutch population register ("BRP" or Basisregistratie Personen) of the Dutch government, a similar document must be submitted issued in the country where the natural person is registered.

This link gives you access to the portal. There you will find all the information you need, and you can submit your application for registration. 

Registration as a legal entity

If an intermediary uses a legal entity, the legal entity must be registered as intermediary. This registration is separate from registration as a natural person.  
For registration as a legal entity, the following documents must be uploaded to the Portal for intermediaries:

  1. A completed and signed legal entity intermediary statement;
  2. An extract from the Chamber of Commerce related to the legal entity;
  3. An original Certificate of Conduct issued for the legal entity, or if the legal entity is not registered with the Chamber of Commerce, a similar document issued in the country where the legal entity is registered. The document must have been issued: (1) no more than six months before the registration; and (2) for the purpose of representing players and/or clubs.

Costs of registration

The KNVB charges the intermediary for the costs of registration. The costs of registration total € 544.50 per registration (€ 450 exclusive of 21% VAT). The amount must be paid as follows into the following account:

Publication

As of 1 April 2015, the KNVB keeps a register of intermediaries. The names of all registered intermediaries and the transactions with Dutch clubs in which they were involved are published every year, by 31 March at the latest. In addition, the KNVB publishes the total amount that every Dutch club has paid that year to registered intermediaries for negotiations about players' contracts and/or transfers.


Disciplinary bodies

Registered intermediaries are bound by the Articles of Association and/or regulations of the KNVB, UEFA and/or FIFA and/or decisions of one or more of their bodies and are subject to the jurisdiction of KNVB bodies, including disciplinary bodies and the Court of Arbitration.
